Privacy policy

This privacy policy clarifies the nature, scope and purpose of the processing of personal data (hereinafter referred to as "data") within our online offering and related websites, functions and content, as well as external online presences such as our social media profile (hereinafter collectively referred to as "online offering"). Regarding the terms used, such as "processing" or "Data controller", we refer to the definitions in Art. 4 of the General Data Protection Regulation (GDPR).

Terminology used

"Personal Data" means any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

"Processing" means any operation or set of operations which is performed on personal data, whether or not by automated means. The term is broad and covers virtually any handling of data.


"Pseudonymisation" means the processing of personal data in such a way that the personal data can no longer be associated with a specific data subject without the use of additional information, provided that such additional information is kept separate and subject to technical and organisational measures to ensure that the personal data is not associated with an identified or identifiable natural person.

"Profiling" means any form of automated processing of personal data consisting of using personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

The "data controller" is the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data.

"Processor" means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

Relevant legal basis

In accordance with Art. 13 GDPR, we inform you of the legal basis of our data processing. If the legal basis is not stated in the privacy policy, the following applies: The legal basis for obtaining consent is Art. 6 para. 1 lit. a and Art. 7 GDPR, the legal basis for processing to fulfil our services and implement contractual measures and respond to enquiries, is Art. 6 para. 1 lit. b GDPR, the legal basis for processing to fulfil our legal obligations is Art. 6 para. 1 lit. c GDPR, and the legal basis for processing to protect our legitimate interests, is Art. 6 para. 1 lit. f GDPR. If vital interests of the data subject or another natural person require the processing of personal data, Art. 6 para. 1 lit. d GDPR serves as the legal basis.

Security measures

We take appropriate technical and organisational measures in accordance with Art. 32 GDPR, considering the state of the art, the costs of implementation and the nature, scope, context and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons, to ensure a level of security appropriate to the risk.

These measures include, in particular, protecting the confidentiality, integrity and availability of data by controlling physical access to data, as well as access, input, transfer, availability and separation of data. We also have procedures in place to ensure the exercise of the rights of data subjects, the deletion of data, and the response to data threats. In addition, we take the protection of personal data into account in the development and selection of hardware, software and procedures, in accordance with the principle of data protection by technological design and data protection-friendly default settings (Art. 25 GDPR).

Cooperation with processors and third parties

If, as part of our processing, we disclose, transfer or otherwise grant access to data to other persons and companies (processors or third parties), this will only be done based on legal permission (e.g. if the transfer of data to third parties, such as payment service providers, is necessary for the fulfilment of the contract pursuant to Art. 6 para. 1 lit. b GDPR), you have consented, a legal obligation provides for it, or based on our legitimate interests (e.g. when using agents, web hosts, etc.).


If we entrust third parties with the processing of data based on a so-called "order processing contract", this is done based on Art. 28 GDPR.

Transfers to third countries

If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if this occurs in the context of the use of third-party services or the disclosure or transfer of data to third parties, this will only occur if this is necessary to fulfil our (pre-)contractual obligations, based on your consent, based on a legal obligation or based on our legitimate interests. Subject to legal or contractual authorizations, we will process or have processed the data in a third country only if the specific requirements of Art. 44 et seq. GDPR is met. This means, for example, that the processing takes place based on special warranties, such as an officially recognised determination of a data protection level corresponding to that of the EU (e.g. for the USA through the "Privacy Shield") or compliance with officially recognized special contractual obligations (so-called "standard contractual clauses").

Data subjects' rights

You have the right to obtain confirmation of whether or not your personal data are being processed, as well as access to such data and further information and a copy of the data, pursuant to Art. 15 GDPR.

According to Art. 16 GDPR, you have the right to request the completion or the rectification of inaccurate data concerning you.

In accordance with Art. 17 GDPR, you have the right to demand that the data in question be deleted immediately or, alternatively, to demand that the processing of the data be restricted in accordance with Art. 18 GDPR.

You have the right to obtain the data concerning you that you have provided to us in accordance with Art. 20 GDPR, and to request its communication to other data controllers.

You also have the right to lodge a complaint with the competent supervisory authority in accordance with Art. 77 GDPR.

Right of cancellation

You have the right to withdraw your consent pursuant to Art. 7 (3) GDPR with effect for the future.

Right of objection

You may at any time object to the future processing of data concerning you in accordance with Art. 21 GDPR. In particular, you may object to processing for direct marketing purposes.

Cookies and right to opt out of direct marketing

Cookies" are small files that are stored on users' computers. Different information can be stored within the cookies. A cookie is primarily used to store information about a user (or the device on which the cookie is stored) during or after their visit to an online service. Temporary cookies, or "session cookies" or "transient cookies", are cookies that are deleted after a user leaves an online service and closes their browser. The content of a shopping basket in an online shop or a login status, for example, can be stored in such a cookie. "Permanent" or "persistent" cookies are cookies that remain stored even after the browser is closed. For example, the login status can be saved if the user visits the website after several days. The interests of users can also be stored in such a cookie and used for reach measurement or marketing purposes. "Third-party cookies" are cookies that are offered by providers other than the data controller who operates the online service (otherwise, if they are only their cookies, they are referred to as "first-party cookies").

We may use both temporary and persistent cookies, and we provide information about these cookies in our Privacy Policy.

If users do not want cookies to be stored on their computer, they are prompted to disable the option in their browser's system preferences. Stored cookies can be deleted in the system settings of the browser. The exclusion of cookies can lead to functional restrictions of this online offering.

A general opt-out of the use of cookies for online marketing purposes can be declared for numerous services, especially in the case of tracking, via the US website https://www.aboutads.info/choices/ or the EU website https://www.youronlinechoices.com/. You can also disable the storage of cookies in your browser settings. Please note that you may not be able to use all the features of this website.

Data deletion

The data processed by us will be deleted, or its processing restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated in this Privacy Policy, the data stored by us will be deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any statutory retention obligations. If the data is not deleted because it is required for other legally permissible purposes, its processing will be restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax reasons.


According to legal requirements in Germany, the retention period is 10 years in accordance with §§ 147 para. 1 AO, 257 para. 1 no. 1 and 4, para. 4 HGB (books, records, management reports, accounting vouchers, commercial books, tax-relevant documents, etc.) and 6 years in accordance with § 257 para. 1 nos. 2 and 3, para. 4 HGB (commercial letters).


According to the legal requirements in Austria, the retention period is 7 years pursuant to § 132 para. 1 BAO (accounting documents, receipts/invoices, accounts, receipts, business records, income and expense statements, etc.), 22 years for real estate and 10 years for documents related to electronically provided services, telecommunications, radio and television services provided to non-entrepreneurs in EU member states for which the Mini-One-Stop-Shop (MOSS) is used.

Business-related processing

We also process
- Contract data (e.g. subject of the contract, duration, customer category)
- Payment data (e.g. bank details, payment history)
of our customers, interested parties and business partners for the purpose of providing contractual services, service and customer care, marketing, advertising and market research.

Order processing in the online shop and customer account

We process our customers' information as part of the ordering process in our online store to enable them to select and order the products and services they choose, as well as for payment and delivery or fulfilment.

The data processed includes inventory data, communication data, contract data, payment data and the data subjects are our customers, interested parties and other business partners. The processing is carried out for the purpose of providing contractual services in connection with the operation of an online shop, billing, delivery and customer service. We use session cookies to store the contents of the shopping cart and permanent cookies to store the login status.

The processing is carried out based on Art. 6 para. 1 lit. b (execution of order processes) and c (legally required archiving) GDPR. The information marked as necessary is required to justify and fulfil the contract. We will only disclose the data to third parties in the context of delivery, payment or within the scope of legal authorisations and obligations towards legal advisors and authorities. The data will only be processed in third countries if this is necessary for the fulfilment of the contract (e.g. at the customer's request for delivery or payment).

Users have the option to create a user account that allows them to view their orders. As part of the registration process, users are provided with the required mandatory information. User accounts are not public and cannot be indexed by search engines. If the user has cancelled their account, his data relating to the account will be deleted, unless their retention is necessary for commercial or fiscal reasons in accordance with Art. 6 para. 1 lit. c GDPR. Information in the customer account will remain until it is deleted, with subsequent archiving in the event of a legal obligation. Users are responsible for backing up their data before the end of the contract in the event of termination.

We store the IP address and the time of the respective user action as part of the registration and login process, as well as the use of our online services. This data is stored to protect our legitimate interests and those of the user against abuse and other unauthorized use. These data are not passed on to third parties, unless this is necessary for the pursuit of our claims or a legal obligation exists in accordance with Art. 6 para. 1 lit. c GDPR.

The deletion takes place after the expiration of the legal warranty and similar obligations, the necessity of storing the data is reviewed every three years; in the case of legal archiving obligations, the deletion takes place after their expiration (end of the commercial law (6 years) and tax law (10 years) retention obligation).

Therapeutic services and coaching

We process the data of our clients and interested parties, as well as other clients or contractual partners (collectively referred to as "clients") in accordance with Art. 6 para. 1 lit. b) GDPR to provide them with our contractual or pre-contractual services. The data processed in this context, as well as the nature, scope, purpose and necessity of the processing, are determined by the underlying contractual relationship. The data processed generally includes inventory and master data of the client (e.g. name, address, etc.) as well as contact data (e.g. e-mail address, telephone number, etc.), contract data (e.g. services used, fees, names of contact persons, etc.) and payment data (e.g. bank details, payment history, etc.).


As part of our services, we may also process special categories of data in accordance with Art. 9 para. 1 GDPR, in particular information about the health of customers, possibly about their sex life or sexual orientation, ethnic origin or religious or philosophical beliefs. For this purpose, we obtain, if necessary, in accordance with Art. 6 para. 1 a., Art. 7, Art. 9 para. 2 lit. a. GDPR and otherwise process the special categories of data for purposes of preventive health care based on Art. 9 para. 2 lit. h. GDPR, § 22 para. 1 no. 1 b. BDSG (Federal Data Protection Act).

If necessary for the fulfilment of the contract or required by law, we disclose or transmit the client's data in the context of communication with other professionals, third parties involved in the fulfilment of the contract, such as billing offices or comparable service providers, insofar as this serves the provision of our services in accordance with Art. 6 para. 1 lit. b. GDPR, legally in accordance with Art. 6 para. 1 lit. c. GDPR. GDPR, is required by law pursuant to Art. 6 para. 1 lit c. GDPR, serves our interests or those of our clients in efficient and cost-effective healthcare as a legitimate interest pursuant to Art. 6 para. 1 lit f. GDPR or is necessary and pursuant to Art. 6 para. 1 lit. d. GDPR to protect the vital interests of clients or another natural person or in the context of consent pursuant to Art. 6 para. 1 lit. a., Art. 7 GDPR.

The data is deleted when the data is no longer required to fulfil contractual or statutory duties of care and to deal with any warranty and comparable obligations, whereby the necessity of retaining the data is reviewed every three years; otherwise the statutory retention obligations apply.

External payment service providers

We use external payment service providers through whose platforms users, and we can make payment transactions (e.g., each with a link to the privacy policy, Paypal (https://www.paypal.com/de/webapps/mpp/ua/privacy-full), Klarna (https://www.klarna.com/de/datenschutz/), Skrill (https://www.skrill.com/de/fusszeile/datenschutzrichtlinie/), Giropay (https://www.giropay.de/rechtliches/datenschutz-agb/), Visa (https://www.visa.de/datenschutz), Mastercard (https://www.mastercard.de/de-de/datenschutz.html), American Express (https://www.americanexpress.com/de/content/privacy-policy-statement.html)).

For the fulfilment of contracts, we use payment service providers based on Art. 6 para. 1 lit. b. GDPR. In addition, we use external payment service providers based on our legitimate interests pursuant to Art. 6 para. 1 lit. f. GDPR. GDPR to provide our users with effective and secure payment options.
The data processed by the payment service providers includes inventory data, such as the name and address, bank data, such as account numbers or credit card numbers, passwords, TANs and checksums as well as the contract, totals and recipient-related information. The information is required to carry out the transactions. However, the data entered is only processed by the payment service providers and stored by them. This means that we do not receive any account or credit card-related information, but only information with confirmation or negative information about the payment. Under certain circumstances, the data may be transmitted by the payment service providers to credit agencies. The purpose of this transmission is to check identity and creditworthiness. Please refer to the terms and conditions and data protection information of the payment service providers.

Payment transactions are subject to the terms and conditions and privacy notices of the respective payment service providers, which are available on the respective websites or transaction applications. We also refer to these for further information and to exercise your right of objection, information and other rights as a data subject.

 

Administration, accounting, office organisation, contact management

We process data as part of the administration and organisation of our business, financial accounting and compliance with legal obligations, such as archiving. In doing so, we process the same data that we process as part of the provision of our contractual services. The bases for the processing are Art. 6 para. 1 lit. c. GDPR, Art. 6 para. 1 lit. f. GDPR. Customers, interested parties, business partners and website visitors are affected by the processing. The purpose and our interest in the processing is the administration, financial accounting, office organisation, archiving of data, i.e. tasks that serve the maintenance of our business activities, the fulfilment of our tasks and the provision of our services. The erasure of data relating to contractual services and contractual communications corresponds to the information specified in these processing activities.

We may disclose or transfer information to tax authorities, advisors such as accountants or auditors, other fee centres and payment service providers.

We also store information about suppliers, event organisers and other business partners based on our business interests, for example to contact them at a later date. We generally store this mainly business-related information on a permanent basis.

Registration function

Users may create a user account. As part of the registration process, users are required to provide mandatory information, which is processed in accordance with Art. 6 para. 1 lit. b GDPR for the purpose of providing the user account. The data processed includes, in particular, the login information (name, password and email address). The data entered during registration is used for the purpose of using the user account and its purpose.

Users may be informed by e-mail of information relevant to their account, such as technical changes. If users have cancelled their user account, their data relating to the user account will be deleted, subject to any legal obligation to retain such data. It is the user's responsibility to back up their data before the end of the contract in the event of cancellation. We are entitled to irretrievably delete all user data stored during the term of the contract.

In connection with the use of our registration and login functions and the use of the user account, we store the IP address and the time of the respective user action. This data is stored based on our legitimate interests and those of the user in protecting against abuse and other unauthorised use. This data will not be passed on to third parties unless this is necessary for the pursuit of our claims or a legal obligation exists in accordance with Art. 6 para. 1 lit. c. GDPR. IP addresses are anonymised or deleted after 7 days at the latest.

Comments and contributions

If users leave comments or other contributions, their IP addresses may be stored on the basis of our legitimate interests within the meaning of Art. 6 para. 1 lit. f. GDPR for 7 days. GDPR may be stored for 7 days. This is done for our security in case someone leaves illegal content in comments and posts (insults, prohibited political propaganda, etc.). In this case, we may ourselves be prosecuted for the comment or post and are therefore interested in the identity of the author.
Furthermore, we reserve the right, based on our legitimate interests pursuant to Art. 6 para. 1 lit. f. GDPR, to process user data for the purpose of spam detection.

On the same legal basis, we reserve the right to store users' IP addresses for the duration of surveys and to use cookies to avoid multiple voting.

Data provided in the context of comments and contributions will be stored permanently by us until the user objects.

Contact

When contacting us (e.g. by contact form, e-mail, telephone or via social media), the user's data will be used to process the contact request and its handling in accordance with Art. 6 para. 1 lit. b. (in the context of contractual/pre-contractual relationships), Art. 6 para. 1 lit. f. (other requests) GDPR. The user's data may be stored in a customer relationship management system ("CRM system") or comparable enquiry organisation.

We will delete enquiries when they are no longer required. We review the need for retention every two years, subject to legal retention requirements.

Newsletter

The following details are intended to inform you about the content of our newsletter and the procedures for registration, delivery, statistical evaluation and your rights of objection. By subscribing to our newsletter, you agree to receive it and to the procedures described.

Newsletter content: We only send newsletters, emails and other electronic messages containing promotional information (hereinafter referred to as "Newsletters") with the consent of the recipient or with legal authorisation. If the content of the newsletter is specifically described at the time of registration for the newsletter, this will be decisive for the user's consent. Otherwise, our newsletters contain information about our services and us.

Double Opt-In and Logging: Subscribing to our newsletter is a double opt-in process. This means that after registering, you will receive an email asking you to confirm your registration. This confirmation is necessary to prevent anyone from registering using someone else's email address. Subscriptions to the newsletter are logged to be able to prove the registration process in accordance with legal requirements. This includes recording the time of registration and confirmation and the IP address. Changes to your information stored with the mailing service provider are also logged.

Registration data: To register for the newsletter, it is sufficient to enter your email address. Optionally, we ask you to provide
a name so that we can address you personally in the newsletter.

The newsletter and the associated performance measurement are sent based on the recipient's consent in accordance with Art. 6 par. 1 lit. a, Art. 7 GDPR in connection with § 7 para. 2 no. 3 UWG (Unfair Competition Act) or, if consent is not required, based on our legitimate interest in direct marketing in accordance with Art. 6 para. 1 lt. f. GDPR in conjunction with § 7 para. 2 no. 3 UWG. GDPR in conjunction with § 7 para. 3 UWG.

The logging of the registration process is based on our legitimate interests in accordance with Art. 6 para. 1 lit. f GDPR. We are interested in using a user-friendly and secure newsletter system that serves both our business interests and the expectations of users, and also allows us to prove consent.

Unsubscribe/revocation - You may unsubscribe from our newsletter at any time, i.e. revoke your consent. You will find a link to unsubscribe at the end of each newsletter. We may store
the unsubscribed email addresses for up to three years based on our legitimate interests before deleting them, to be able to prove that consent was previously given. The processing of this data is limited to the purpose of possible defence against claims. An individual request for deletion is possible at any time, provided that the previous existence of consent is confirmed at the same time.

Hosting and delivery of email messages

The hosting services we use provide the following services: Infrastructure and platform services, computing capacity, storage and database services, email delivery, security services and technical maintenance services that we use to operate this online offering.

We or our hosting provider
process inventory data, contact data, content data, contract data, usage data, metadata and communication data of customers, interested parties and visitors to this online offering based on our legitimate interest in an efficient and secure provision of this online offering in accordance with Art. 6 para. 1 lit. f GDPR in connection with Art. 28 GDPR (conclusion of contract). Art. 28 GDPR (conclusion of contract for order processing).

Collection of access data and log files

We or our hosting provider collect data based on our legitimate interests within the meaning of Art. 6 para. 1 lit. f. GDPR about each access to the server on which this service is located (so-called server log files). The access data includes the name of the website accessed, the file, the date and time of access, the volume of data transferred, notification of successful access, the browser type and version, the user's operating system, the referrer URL (the previously visited page), the IP address and the requesting provider.

Log file information is stored for a maximum of 7 days for security purposes (e.g. to investigate misuse or fraud) and is then deleted. Data that needs to be retained for evidence purposes will not be deleted until the incident has been resolved.

Google AdWords and conversion measurement

Based on our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f. GDPR), we use the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA ("Google")

Google is certified under the Privacy Shield Program, which guarantees compliance with European data protection laws (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

We use Google's online marketing service, AdWords, to serve ads to Google's network of advertisers (e.g., in search results, videos, on webpages, etc.) so that they may be displayed to users who we think may be interested in those ads. This allows us to better target ads for and within our online offering, so that users are only shown ads that may be relevant to their interests. For example, showing a user ads for products they have shown interest in on other online properties is called "remarketing". To do this, when you visit our site or any other site on which the Google advertising network is active, Google will execute a code on your behalf and place a Google (re)marketing tag (an invisible graphic image or code, also known as a "web beacon") on your web page. These tags are used to place a unique cookie, a small file, on the user's device (similar technologies can be used instead of cookies). This file records which web pages the user has visited, what content the user is interested in, what offers the user has clicked on, as well as technical information about the user's browser and operating system, referring web pages, time of visit and other information about the use of the online offering.

We also receive a unique "conversion cookie". The information collected by the cookie is used by Google to compile conversion statistics for us. However, we only receive the anonymous total number of users who clicked on our ad and were taken to a page with a conversion tracking tag. We do not receive any personally identifiable information.

User data is processed pseudonymously within the Google advertising network. This means that
Google does not store or process the user's name or email address, for example, but processes the relevant data in connection with cookies within pseudonymised user profiles. This means that, from Google's perspective, the ads are not served and displayed for a specific individual, but rather for the cookie owner, regardless of who that cookie owner may be. This does not apply if a user has expressly permitted Google to process the data without this pseudonymisation. The information generated by the cookie is transmitted to and stored by Google on servers in the United States.

Online presence in social media

We maintain online presences on social networks and platforms to communicate with and inform customers, prospects and users active on such networks and platforms about our services. Access to these networks and platforms is subject to the terms and conditions and privacy policies of the respective operators.

Unless otherwise stated in our Privacy Policy, we process users' data when they communicate with us within the social networks and platforms, e.g. by posting on our sites or sending us messages.

Integration of third-party services and content

Based on our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offering within the meaning of Art. 6 para. 1 lit. f. GDPR), we use content or service offers from third parties within our online offering to integrate their content and services, such as videos or fonts (hereinafter collectively referred to as "content").

This always requires that the third-party providers of this content recognise the user's IP address, as they would not be able to send the content to the user's browser without the IP address. The IP address is therefore required to display this content. We endeavour to use only content where the content provider uses the IP address to deliver the content. Third parties may also use pixel tags (invisible graphics, also known as web beacons) for statistical or marketing purposes. Pixel tags can be used to analyse information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user's device and may include, among other things, technical information about the browser and operating system, referring websites, time spent on the site and other information about the use of our online offering, and may be linked to such information from other sources.

Google Maps

We integrate maps from the "Google Maps" service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The data processed may include, in particular, IP addresses and location data of users, which are not collected without their consent (usually as part of the settings of their mobile devices).
